Background



There are a variety of challenges to housing, land, and property rights that arise in the context Of conflict-induced displacement. They range from disputes over property ownership, to unlawful expropriation of properties, to forced eviction, to incomplete/inconsistent legal framework, to discrimination against women and minorities, to massive destruction of housing and public services, Besides many other problems, land and property issues are increasingly creating challenges for the

immediate operational work of humanitarian actors. Moreover, there is a growing recognition that land, and property rights related issues will be a critical challenge for the future stability and recovery of a post-agreement Syria. Recognizing the need, a joint programming response was initiated to deal with issues pertaining property and land management for contributing to stability, social cohesion and peace building in Syria.

As a response to the emerging needs of the Syrian population, and in line with the overall framework of the Syria Humanitarian Response Plan, Strategic Framework for Syria (UNSF2016-2019) and UNDP Country Programme Document (CPD 2016-2019), UNDP is working under three main portfolios:

Infrastructure and Basic Service Rehabilitation, Socio-economic Recovery and Social Cohesion and Local Development.

This Action proposes to strengthen the technical and operational capacity of key stakeholders to be able to provide technical HLP support to on-going humanitarian and recovery activities, as well as to prepare for longer-term, post-agreement issues. UNDP is committed to responding to the HLP needs of Syrians, including internally displaced people, and integrating HLP matters into its work on the Under the overall guidance of the UNDP Syria Resident Representative and deputy country director, direct supervision of the Social Cohesion Team Leader, and working closely with relevant UNDP teams,

the Legal Expert will support the implementation of EU- HLP project and any other initiatives/projects in the domain of HLP.





Objectives



HLP issues are one of the most important factors that can affect community safety, as it can be one of the causes of tension between different social groups, which negatively affects society in general, and especially women, returnees, and the business sector. so that the main objective of this consultancy is to provide a general and comprehensive vision on the most influential topics in legal issues and the impact of the legal structure on property issues through analytical papers and guidance

notes on some laws and topics related to HLP issues ,and their impact on social cohesion on one hand and on the business sector on the other hand, such as laws on investment and real estate development, the dangerous of unexploded substances on land or property, and how the legal and social structure deals with women's rights in relation to land or property issues.



Specific Objectives:



The expert is expected to produce the following Deliverable:



Deliverable 1: prepare thematic legal analytical papers on priority HLP issues from the perspective of national and international law

- Prepare at least three thematic legal papers on Real estate investments, Debris management, and Infrastructure development law, in cooperation with national advisors within each field. each paper should identify most important changes in the legislative system related to relevant laws and determining and analyzing the logical framework for amending or repealing the relevant laws before and after 2010.

- Preparing at least 2 analytical studies for the most important Syrian laws related to the HLP issues as determined by UNDP.



Deliverable 2: prepare Technical guidance notes to support humanitarian and recovery activities. Prepare at least three Guidance Notes which are intended to be more focused on specific HLP related issues that impact on existing and planned humanitarian, resilience, and recovery programming in particular in the below topics

- HLP and Debris Management.

- Gender and HLP.

- HLP and UXOs / ERW.



Deliverable 3: Monthly reports on the updated HLP and legal issues:

- the most important legal and social developments related cases.

- Summarize the new laws.

- New circular.

- New legal measures taken related to HLP issues.

- Follow-up on all Syrian and foreign media reports regarding the most important topics related to HLP issues.



Deliverable 4: Provide legal support for all activities related to the work of HLP program.

Qualifications
Key Competencies

- Solid understanding of the concept of human development and related themes;

- Strong analytical skills, fair and sound judgment;

- Effectiveness in meeting tight deadlines;

- High level of competency in English required;

- Ability to work independently and achieve quality results with limited supervision and within tight schedules.


Specific Vacancy Requirements
Qualifications of the Successful Individual Contractor

Education:

University degree in a relevant field (law, human rights, political and social sciences, or a related field)

Experience:

- At least 10 yea s relevant experience working on related programming Knowledge of HLP issues in emergency, post-conflict and transitional settings

- Proven leadership and coordination skills

- Excellent speaking and writing skills; knowledge of local language preferred

- Prior experience within the United Nations, in particular UNDP, is desirable but not a requirement.
